Contact your local Child Support Agency.

Collecting child support from a deadbeat lawyer may seem a little intimidating but gather your paperwork and get ready because it is easier than you think. This process takes patience and persistence but will eventually get the support you need to help you take care of your child. The National Child Support Association has a website that will direct you to the correct agency for your state (see below for website). This is a government-run agency and is there to help collect support.

Instructions

  1. Set up an Appointment

    • 1

Set up an appointment with the Child Support agency in your state and county. The agency will tell you if there is a charge for this service.

    • 2

Gather all paperwork involving the child support including the court order and any payments made. Calculate and write down the payments missed. The agency will require this information with the current address of person responsible for making the payments. Have enough information to track the person, including a work address and phone number.

    • 3

Go to your appointment and explain the circumstances. Give the agency a copy of all the documents related to the child support. The agency will then petition the court and have the person brought in before a judge. If the lawyer misses this court date, there will be a warrant issued for their arrest.

    • 4

Be patient it may take some time, but eventually the child support agency will track the lawyer down with your help.

    Contact a Lawyer

    • 5

Contact a lawyer for faster results and discuss the option of filing for a motion of contempt of court. Not all lawyers know each other so do not be afraid they will take the side of the deadbeat lawyer. This is the preferred way as the State Agency may be backed up and take a while to get a court date.

    • 6

Tell your Lawyer to refuse any requests for extensions on the court date unless it is an extreme emergency (death in the family, in the hospital, etc.) on their part. A lawyer may try to delay the court date using their job as an excuse, but do not let this happen.

    • 7

Make sure to attend all court dates unless your lawyer states you do not have to be present. Most of the time you will be required to attend.

Tips & Warnings

  • Asking the court for garnished wages will continue the child support in a timely manner.

  • Agencies are only allowed to help people that have court ordered child support. If there is not a court order you will need to retain a lawyer.

  • The agency will ask why you have waited so long to get this resolved. Give an honest answer.
