How to Win DUI Charges
A DUI (driving under the influence) is a serious driving infraction that no only may result in you losing your license (and adds points) but also in your auto insurance rate rising. If you are accused of driving under the influence, you need to prove what the police officer did is not legal, and therefor your charges should be thrown out.

Obtain the police tape from the officer's vehicle the night you received the DUI. This is public domain and you may request the information from the police station. Watch the tape and compare the officer's statements against what occurred on the tape.

Prove the officer unjustly stopped you. If the officer did not have any legal reason to stop you, then the DUI never should have been administered and the case is dropped. Swerving inside your own lane is not illegal.

Bring up the fact that the office never read you your Miranda rights. Although this doesn't always work, if you are not read your own rights the case may be thrown out.

Compare the breathalyzer tests you took both on the scene and at the police station. The legal limit in most states is .08. However, blood alcohol continues to rise over the better part of an hour, so if you blew a .08 at the station, chances are the breathalyzer you took on the scene proves you were under the legal limit at the time you drove.
