How to Serve an Eviction Notice in WI
In Wisconsin, a tenant can be evicted for either not paying rent or causing a disturbance to those around them. Before you can serve an eviction notice, you must first have a lawyer draw up a written notice citing Wisconsin Statute 704.17. This notice can come in several forms, and it warns the tenant that he is late with rent or is disturbing neighbors or individuals in the area. If the tenant persists, you have the right to seek out and serve an eviction notice.

Go to a local courthouse to obtain a Summons Notice from the courthouse clerk. The clerk will give you a form to fill out that officially files the eviction proceeding with the court. The clerk will give you a court date, which must be added to the Summons Notice. The clerk will give the Summons Notice to a judge to sign once you have filled it out, then return it to you.

Serve the eviction notice by giving it directly to the tenant or someone in the tenant's family older than 14. Be sure to show up on the date of the hearing. Only a judge can make a ruling on whether the tenant is evicted or is allowed to stay.
