How to Start a Company in New York

Starting a business in New York City.

New York has long been considered the mecca of business in America. It is important to have a business plan before starting. Equally important is getting the proper training and education to operate your chosen business. Location and finding financing for your business can also be challenging. Starting a business in New York is not as hard as one may assume. One of the first things to do is to select the business name and register that name with the State of New York's Secretary of State.

1. If you are a sole proprietor, file a business certificate with the clerk of the county you want to open the business in. If in a partnership, fill out a business certificate for the partners and file with the clerk of the county. When starting a corporation, or limited partnership, register a business name as part of the filings with the New York Department of State.

2. Decide on how the business will be structured. For any type of business, whether a corporation, a non-profit, a limited liability company or a partnership, you must register with the State of New York.

3. Go to the New York State Citizen Guide (see Resource section). Click on "Starting a Business." Find information appropriate to your business situation.

4. Get an EIN or employer identification number from the IRS. Register the business with the New York State Department of Taxation and Finance.

5. Determine your business's license requirements by visiting the state's Licensing Requirements website (see Resource section). Then go to the Licenses and Permits website for the licensing needs of the locality where you plan to do business (also in Resource section).
