How to File for Legal Separation in New Jersey

Legal separation helps couples to decide whether they wish to remain together or divorce. Spending time apart will either make the spouses long to be together again or make them realize how much they really do dislike the relationship. While a majority of states recognize legal separation, New Jersey has no law that gives legal status to a separation. If you and your spouse are New Jersey residents and wish to spend some time apart, there are options available to you.

Instructions

1. Formalize an agreement. Even though the New Jersey court does not recognize legal separations, it will recognize a formal agreement entered into by you and your spouse. The agreement should contain provisions for child custody, visitation, health insurance, taxes, and responsibility for household bills and the mortgage or rent payment.

2. Sign the agreement. For a separation agreement to be valid, it must be signed by both parties.

3. Have the agreement notarized. The separation agreement must be notarized for it to be considered a valid and enforceable document.
