How to Locate a Living Will & Trust

A living will is a document that lays out a person's desires in regards to their medical care should they become incapacitated and terminally ill. This document may specify that a person wants no life support should such technology become necessary. A living trust on the other hand specifies how a person's estate is to be handled should a similar event happen. These are two separate documents, though they're usually penned about the same time. You should already know about them when the time comes, but if you don't then they should be fairly easy to locate.

      Talk to the person in question before anything happens. The easiest way to locate a living will and trust is to talk to the person who might be filling one out, whether it's your parents, your spouse, or just a good friend.

      Talk to their doctor. Ideally you're supposed to discuss a living will with your doctor so that your medical representative knows what your wishes are in advance, should something happen to you.

      Talk to their lawyer. The laws concerning living wills and trusts vary from one state to another, but an attorney is usually the person that will help with a living will and trust so that it's valid and proper.

      Check with the public records office. Some states require that if a person's will, living or otherwise, is to be valid that it has to be notarized and properly filed on record. Since it's a public record, you can just go to the courthouse and request to see it.

      Go through the person's documents. Most people keep important, legal documents in a single area, and that filing cabinet or desk drawer is the most likely place to find a copy of their living will and trust.
