The New York Department of Health keeps a record of various documents, including divorce certificates. The process of obtaining a copy of this certificate involves completing an application, providing identification and paying the appropriate fees. The processing time will depend on the method of application used. Those who are legally able to request a copy of a divorce certificate are the husband, the wife and anyone authorized by the New York State Court.

      Prepare supporting documents. Applicant’s must submit a copy of one of the following: driver's license, state-issued photo ID, passport or U.S. military issued photo ID. If these documents are not available, the applicant must submit a copy of two of the following: a letter from a government agency received within the last six months, a utility bill, or a telephone bill.

      Order the divorce certificate over the phone or online. The department uses VitalChek for their telephone and Internet services.       Complete an application and order a copy of the divorce decree via mail. The department offers two levels of service when you order a divorce certificate by mail. Select “Priority Handling” if you wish to receive the certificate within three weeks, or choose “Regular Handling” to receive it within eight weeks. If you want priority service, the department recommends sending your request via overnight delivery. You may receive the certificate by overnight mail if you send a prepaid return mailer with your request. The fees for priority handling are higher than those for regular handling. Send a check or money order for the fees.
