How to Revoke a HealthCare Power of Attorney

Instructions

1. Step 1) There are really two powers of attorney--durable powers of attorney and healthcare powers of attorney. We make powers of attorney in case we become incapacitated; hence, one of our relatives, friends, business associates, etc. will make decisions on our behalf in lieu of our incapacitation. The first step in revoking a healthcare power of attorney is NOTIFYING THE ATTORNEY IN FACT OR ORALLY that you would like the power of attorney revoked.

2. Step 2) The second step in revoking a healthcare power of attorney is NOTIFYING THE HEALTHCARE PROVIDER ORALLY OR IN WRITING that you would like the healthcare power of attorney revoked. Either step 1 listed above or this step will suffice.

3. Step 3) After the healthcare power of attorney has been revoked, the healthcare provider shall make the notification a part of the patient's medical record, and shall make a reasonable effort to notify the attorney in fact of the revocation.
