      Child custody and guardianship are two diferent types of custody. Child custody is the term usually used when a biological parent seeks custody of a child. Guardianship is the term used when a friend or family members seeks custody of a child. Both terms mean or allow a person to be the primary caretaker.

      There are some situations when a biological parent may filed and seek to have guardianship of their child. This is usually done when their child is 18 years old and is special needs or has other medical or mental issues. Also a biological mother whose child was adopted and now wants the child back or the child wants to go back would seek a guardianship.

      Both are type of custody and both would be granted in a Probate and Family Court. One can also seek guardianship of an adult if the are older or have physical or mental issues and can not mek decisions for themselves.
