The first thing is to file the appropriate forms with the court to be granted a court date to bring this matter to the court and get a court order on it.

Physical custody is who the child lives with the majority of the time. For example during the week and whose area/town the child attends school in. To be granted physical custody there are a few things you need. A home for the child with appropriate bedding. A safe home that is alcohol and drug abuse free, free of any domestic violence, physical, sexual, and emotional abuse free.
A parent must be able to provide financially for the child so they will have food and the basic needs. One should if possible have a car in case of emergencies.

A parent must be fit. Have no major criminal issues or mental health issues that put the children at risk. To be granted physical custody you should be involved in your child's medical and schooling. Know the doctors and teachers, attend school meeting and be available if your child is sick. You should be available to care for the child, put the child on the bus in the morning and be home for dinner. Daycare and after -school care are fine but working nightly until 9pm is not in the child's best interest. Fitness and good judgment are the best way to be granted custody.. If custody is contested the court will decide and the above are a few things they will review. Note being involved now and not before is not a good idea.
