If you are a mother and you had a child out of wedlock you can claim the child on your taxes as long as you have no court orders for legal custody. If you do then you will need to get a court order to claim the child or have an agreement with the other parent. Why? If y you both claim then the IRS will penalize one of you and ask for money back.

If you are divorced or separated you need to have an agreement on who will claim the child. How does one file or get a court order to claim the child or children?

Go to the court where you case is being heard and file a motion or modification so you can get the right to claim your child/ children on your taxes. You will need to file forms with the court and serve them to the other party. When you go to court be prepared of why you should claim the children.
