How to Obtain Copy of Provisional Patent Application

A provisional patent is a patent that can be obtained while the invention is still being tested. This is what is referred to as "patent pending." A provisional patent is filed to preserve the rights to the invention, while the claims, declaration, and disclosures necessary for a formal patent are still being developed. Copies of provisional patent applications are publicly available and are obtained online.

      Go to the United States Patent and Trademark Office's website and visit their Patent Application Information Retrieval page at uspto.gov. A link to this page is provided in the Resource section below.

      Click on the button for the option you would like to search for the application by. You can search by application number, control number, patent number, PCT/international number or publication number. Type in the number in the field below and click the search button. If you do not know any of this information, Google Patent Search allows you to search for patent information by invention name, inventor name, assignee name, issue date, filing date or classification code. Visit Google Patent Search by clicking on the link in Resource below.

      Click on "Order Application" when the patent information comes up. You will be navigated to a shopping cart page.

      Click on "checkout" to enter payment information and to select a delivery method. You will be asked to set up a username and password. The website accepts all major credit cards, or you can do an electronic bank transfer. Choose whether to have a downloadable PDF version of the application sent to you over the Internet, or to have a paper copy or a CD with an electronic file mailed to you. The processing time for Internet deliveries is about one business day. The processing for mail deliveries is five to 10 business days.
