How to Create a Legal and Binding Agreement

Creating a legal and binging agreement between multiple parties can be done in a multitude of ways---either by drafting a contract through an attorney, or by obtaining an online legal contract (available through various legal websites). A lawyer can draft you a contract in person, but will charge you a hefty fee. An online legal contract can be drafted through various online legal websites, often for a minimal fee. In an online contract, you can fill in the details on your own (ie: payment terms, exchange of goods or services), and then have the contract notarized when you and the other party sign it to make it legally binding. However, to best protect yourself, you should have a lawyer or other legal professional review your agreement before signing it.

Instructions

    • 1

Consult with the other party you will be creating a legal and binding agreement with. Come to a verbal agreement on the terms and conditions of this arrangement you will be making. This will help eliminate confusion later on and keep everyone on the same page.

    • 2

Consult a lawyer or legal professional about the terms and conditions you and the other party (or parties) have agreed on verbally. Allow your lawyer to create an agreement on your behalf.

    • 3

Review the agreement your lawyer has created before going to the other party involved. Be sure that all of your needs are being met, and that the agreement seems fair and balanced.

    • 4

Have your lawyer send the agreement to the other party (or you can send it directly). They will typically have a certain amount of time to review the agreement and respond (typically 30 days). If that time expires, a new agreement will have to be drafted.

    • 5

Sign the agreement in the presence of your lawyer, the other party and their lawyer. You may also choose to have another party present who will also sign the documents as a witness. This will ensure that all parties involved are aware of the events taking place, and the witness could be legally called upon to validate the agreement if there are any discrepancies later on.

Tips & Warnings

  • If you create a legally binding contract online on your own, be sure to have the agreement notarized when you and the other party sign the agreement. This will make the contract valid within your state.
