How to Dispute a Federal Criminal Record

Disputing a federal criminal record is a vital step if there are any errors under your name and you're applying for a job or any type of loan. Most prospective employers or banks look to your credit report in place of a background check; and if there are mistakes on your criminal record, they will appear here. While it may sound like a difficult process, disputing a federal criminal record is not difficult if you take the time to do it properly.

      Contact your local police department and make an appointment to be fingerprinted on a State Applicant Fingerprint Card. Once you receive the card, be sure to check off the box marked "individual review or challenge of record." Mail the fingerprint card with a $30 certified bank check to "Division of State Police- SBI" to the state police address in your state. You must also include a letter telling the purpose of your request (to dispute a criminal record), your name and the mailing address where they can forward the response.

      Review the rap sheet carefully once it has been mailed to you and find all errors. Go to the court where the case was originally heard and obtain a copy of the Judgment of Conviction (JOC) with the correct information on it. Send the rap sheet and JOC to the Criminal Record Repository along with a letter explaining how the information on the JOC contradicts the information on your criminal record. Once the record has been officially changed, the Criminal Record Repository will contact you.

      Obtain a copy of your credit report and find the errors regarding your criminal record. Circle any errors on the report and write them a letter explaining your situation. Include a copy of your updated JOC for their records. Mail all of the following to your local consumer report agency. The agency will take approximately 30 days to review your file. If all of the appropriate information supports your claim, they will revoke the errors and clear your name.
