First, collect all documentation you have regarding the money owed. NEVER loan money to someone without documentation signed by both you and the person. If your small claim is from a company, collect any receipts they may have given you.

Next, it's time to file your claim in Small Claims Court. You'll need to determine what Court has jurisdiction over your issue. It will either be where that person lives, where the incident took place or possibly where you live. Ask the clerk if you can't decide. Make sure you have the contact information for the other party, if you don't have any contact information, that person will not be served.

Finally, on your Court date, bring all your documentation into the Court with you. It helps to write out a timeline of events or a statement to tell the Judge. Getting up in front of the Judge can be nerve racking, so figure out what you're going to say beforehand.

Tip: Remember, even if you get a judgment, it's just a piece of paper. Further action may be needed if the other party still refuses to pay, but also remember, if the other party does not have the money to pay you, they can't pull money out of thin air.
