How to Fill Out Colorado Divorce Papers

An uncontested divorce in Colorado can be filed by filling out the proper forms and submitting them to your local county courthouse. All the papers you should need to properly determine division of property, child custody and child support figures are available through the local county or state website. Instructions

    • 1

Fill out a Petition for Dissolution of Marriage (JDF 1101), the Information Sheet (JDF 1000) and the Summons if needed (JDF 1102). The spouse filing for divorce is called the petitioner, and the other spouse is called the respondent. At least one of the parties must have been a Colorado resident for at least 90 days before filing.

    • 2

Come to an agreement with your ex-spouse about how property will be divided. The division must set aside any personal property such as inheritances, and the marital property must be divided fairly between the spouses. A Colorado judge reviews this division document and may block the divorce if the division isn't fair to both parties.

    • 3

Determine with your ex-spouse how parenting time will be handled. You and the other parent can agree to whatever rules you choose if it is in the best interest of your children. Joint physical and joint legal custody are the foundations of child custody; the two of you can describe parenting time in detail or leave the guidelines open if you feel that you can agree now and in the future.

    • 4

Investigate the current Colorado rules for proper financial contribution of both parents to the children's needs. Colorado divorce law child support rules are based on the incomes and financial means of both parents. These worksheets are in your Colorado divorce papers packet or can be obtained from the State of Colorado website. They are called Child Support Worksheet A or Child Support Worksheet B, depending on your situation.

    • 5

Fill out, notarize and file the following forms: Certificate of Compliance (JDF 1104); Sworn Financial Statements (JDF 1111); Separation Agreement (JDF 1115); Parenting Plan (JDF 1113); Decree (JDF 1116); Support Order (JDF 1117); and the Pretrial Statement (JDF 1129) if you and your ex-spouse are disagreeing on issues.

    • 6

Attend an Initial Status Conference to exchange documents and provide the Court with forms you have completed.

    • 7

Attend the final hearing. At this event, if both parties agree to the terms of all documents that have been filed, the judge will review the case and make any adjustments needed. At the conclusion of the final hearing, the Decree and Support Orders will be entered into the public record, making the divorce final.

Tips & Warnings

  • Consult a lawyer or mediator if you are disagreeing on issues. Keep the parenting time and child support decisions flexible to allow for changes in the future. As your children grow older, their needs will likely change. In addition, circumstances for one ex-spouse or the other could change in the future.
