Break An Apartment Lease and Walk Away
Break An Apartment Lease and Walk Away

If you are fed up and want to break your apartment lease, you may be surprised to find that the law has numerous provisions that allow unhappy tenants to leave.

Difficulty: Moderately Challenging
Instructions
  1. Step 1

Review your lease for any lease break provisions. If you are lucky, you'll only have to pay a fee to break the lease and move.

  2. Step 2

Consider whether your landlord is attentive to your needs as a tenant. Do problems get fixed in a timely manner? If not, you may have legal grounds to break your lease.

  3. Step 3

Consider the noise level in and around your apartment building. Most cities have a noise ordinance. You may be able to use this to get out of your lease penalty free.

  4. Step 4

Explain the situation to your landlord if you believe he or she is reasonable. Your landlord may be willing to allow you to leave if you help find a qualified tenant to take your place.

  5. Step 5

Check to see if your lease allows subletting. If it does, you can find a tenant to move into your apartment without your landlord having any say in the matter.

  6. Step 6

Leave. Legally your are only responsible for paying the rent until your landlord finds another paying tenant.
