    SEPARATION.
Separation is living apart. You will not have to file papers in court to separate. If you are to separate you will not have alot of legal rights.

LEGAL SEPARATION is to change the status of your marriage. To do this you must file a petition in Superior or Family Division Court. Legal separation is very similar to divorce. You must include child support, custody, visitation, and alimony orders. Being a wife you may not go back to your maiden name. It costs the same as a divorce. SO why get separated? Could be moral or religious beliefs. Could be that medical insurance ill not cover the spouse. Best to get legal advice. Some people want to hold of until the Real Estate market improves so you do not have to sell your house at a low price. A legal separation can last forever. If you want to have more benefits and keep the marriage for 10 years people choose separation for this for the social security benefits.
If your spouse is in the military and you want to wait for their return.

There will be a hearing with temporary issues. Once you fill out the proper paperwork they will be presented to your spouse. They are called a respondent. Both parties must attend a hearing.
