An unfortunate part of managing the human resources department of a company is the need to terminate a person's employment. A business may need to terminate an employee for numerous reasons, including improper conduct, breach of contract or company layoffs. In order to allow the process to go smoothly, you should follow some basic steps when firing someone.

      Prepare the documentation prior to the employment termination meeting. Never plan to terminate employment without prepping ahead of time. If you are firing the person, gather performance reviews and any warnings that may have been issued against the employee.

      Give a just cause for the termination. During the meeting, you will have to give just cause of the firing in order to avoid a wrongful termination lawsuit. For example, if you are firing the person due to excessive absences, you should have time sheets to back up this claim. If employment is being terminated due to layoffs, be prepared to answer questions about the company's financial state.

      Draw up a contract that lists the terms of the employee's termination. Make sure you include severance pay, benefits information and date of termination. Send the document to a lawyer for review prior to presenting to the employee to sign.

      Provide instructions on the return of company property as well as when the employee is required to vacate the premises. Collect any keys, equipment, network passkeys and any other items belonging to the business. During this process, you may want another HR rep or security officer to witness the proceedings. Security will likely only be necessary if you are terminating employment for a criminal reason.

      Keep documentation of the meeting as well as all paperwork signed after the firing has taken place. You may need all communication for legal reasons in the future.
