Employers purchase workers' compensation insurance to protect themselves and their employees. It provides coverage in the event an employee becomes injured on the job or contracts an illness/condition caused by repetitive motions or repeated exposure to a particular danger. Governed by the laws of the state, employees have recourse for such injury/illness by reporting a claim to the workers' compensation carrier.

The employer is protected as a result of purchasing this insurance because employees are less inclined to file a lawsuit against an employer if they are adequately compensated through a workers' compensation claim.

Instructions
  1. Step 1

    Document the occurrence. Jot down the circumstances surrounding the claim such as time of occurrence, whether it was an accident or a cumulative condition. If it's a suspected cumulative injury, document the first time you were exposed to the hazard leading to the workers' compensation claim.

  2. Step 2

    Compile the necessary employment and demographic information such as hours per week worked, salary, position, type of work, length of time with employer, name, address, Social Security number and phone contact numbers.

  3. Step 3

    Obtain the workers' compensation insurance carrier's name, policy number and policy term.

  4. Step 4

    Track and document all medical treatment, whether it's first aid at the time of the accident or the necessity to be transported to the hospital emergency room. Document who provided the medical services, what was done and dates/time of medical attention.

  5. Step 5

    Notify the employer. Whether it's the human resources coordinator, your supervisor or company owner, make sure to let management know about the injury. Document the date and time the employer was notified.

  6. Step 6

    Complete a Report of Injury form. Depending on your employer, you may have to request a copy from the human resources department, or it may be available for download online. Enter the information gathered in steps 1 to 5 above onto the Workers' Compensation Report of Injury form.

  7. Step 7

    Request that the employer complete the employer's section of the workers' compensation claim form, then submit the form to the insurance company.

Tips & Warnings
  • Always keep a copy of all documentation on your workers' compensation claim. Follow up with the insurance company to confirm receipt of the Report of Injury claim form.
  • Don't forget to sign the claim form.
