Grandparents do have the right to go to the Probate and Family Court and file paper work to seek grandparent visitation on a minor child. In order to do this you will need to locate your local Probate and Family Court in the County where you live. If the minor child has Court orders on them from another Court you will need to go to the Court where any orders on the child exist to file your request for visits. Your son or daughter must have been declared the biological parent of the child you are requesting to visit. For example their name on the birth certificate or by Court order.

GO to Courthouse and complete the required forms. You will need to state and or prove why it is in the minor child's best interest to visit with you and why the child would be in harm or a disadvantage if the relationship did not continue. Once you complete the paperwork and make your statement why you should have visits you will need to serve both biological parents or the child's legal guardian with a copy of the forms you completed along with the Court date. Service of these forms needs to be done by a neutral party, constable or sherrif. Then you go to Court and present your case.

Grandparents do not need to be married to seek visitation.
