Legal custody means that both parents have a right and need to agree on any legal decisions made for a child. When a parent wants to move out of state with a child and the other parent has joint legal custody you must both agree to it or you will need to get the Court's permission to do so.

Remember you will need to have a plan for the other parent and child if you wish to live far. What visitation plan do you have, child support may be reduce for increased transportation expenses. The most important factor is why is it in the child's best interest to move, not yours. Be prepared to answer all of these questions. Moving to another state when the other parent contests it is not that easy.
