How to Get a Felony Expunged

People with a felony on their criminal record may have difficulty getting a job, due to their imperfect background checks. The only way to remove a felony from a criminal record is to have it expunged. This is a fairly complicated procedure, but the benefits of a clean record are worth the effort. If you have been convicted of a felony more than once, you cannot have your record expunged. You must also wait five years from the date of your conviction before you can get a felony expunged.

Instructions

1. Know your rights. States have different laws about which crimes can be expunged, and how many years must pass after the crime in order to be eligible. Murder, sexual crimes and crimes punishable by a life sentence in prison are generally not eligible.

2. Hire a lawyer. File a motion in the court where you were convicted.

3. Present your case to the judge. Give a detailed explanation why your record should be expunged, such as good behavior or remorse for your crimes.

4. If your request is denied, submit an appeal.
