How to Create a Rental Agreement
Landlords need to create a rental agreement before renting the property to tenants. The rental agreement, or lease, should be in writing and signed by both the landlord and tenant.

The lease should include the name of landlord and tenant, the property address and the date when the lease begins and ends.

State the monthly rental fee, the monthly rent due date, any late charges, returned check fees and the address where payment should be mailed.

Spell out what happens if the tenant fails to pay rent, including the potential for eviction.

List the amount of security deposit required.

Determine who should pay utilities: the tenant or the landlord.

List how many tenants may live in the property and whether the tenants may sublet the property.

State how and when the landlord may have access to the property.

List any rules and regulations, such as whether tenants may have pets or are allowed to smoke.
