Things You'll Need:
- Attorney
- See RESOURCES below for an Easy online process to transfer your real estate deeds and titles.
-
Step 1
A qualified real estate attorney must be located who has experience with the local deed transfer procedures. You will provide all basic information to the lawyer about the property and individuals to be listed on the title.
-
Step 2
The lawyer will conduct research to determine the exact "legal description" of your real estate and to confirm the current owners listed on the deed. If the property is to be transferred to a trust, a copy of the trust abstract (sometimes titled a Certificate or Abstract of Trust) must be provided.
If the property is to be transferred to a business entity such as an LLC or Corporation, a document proving the existence of the business (a copy of the "Articles of Incorporation" or "Certificate of Formation") must be provided. -
Step 3
If necessary, an affidavit will be prepared in the situation any co-owner on the current deed has died (a certified copy of the death certificate will be required).
-
Step 4
You will sign the new real estate deed and have it notarized. The deed will then be recorded with the proper county recorder's office. The filing and recording time differs by county, but usually takes 4-8 weeks. When completed, the new original deed is mailed to you.
-
Step 5
The goal is to make this legal transfer easy, affordable and time efficient.
