Deal With Illegal Questions in an Interview

Although interviewing for a new job is a stressful situation, it's important to make a good impression. In an effort to ensure a positive outcome, you ready yourself by pressing your suit, practicing your handshake and mentally preparing answers to questions you think your interviewer may ask. While most human resource professionals and hiring managers are aware of the laws relating to employment interviews, you should know how to deal with illegal questions in an interview. Not knowing how to respond could cost you a job.

Instructions

    • 1

Familiarize yourself with the types of questions that are potentially illegal for an employer to ask you during an interview. For example, questions relating to your age, unless you are a minor, your marital status, the number of children you in your household or your plans to become pregnant are usually illegal.

    • 2

Stay calm when an employer asks you a question you think may be an illegal interview question. It is possible the employer is just being friendly or trying to put you at ease with simple questions about your life.

    • 3

Provide a tactful response. Even though you may be dealing with an illegal question during your interview, your response is a representation of you. For example, if you react arrogantly, your prospective employer may conclude you have a bad attitude.

    • 4

Offer a deflective response. Steer the conversation away from the illegal question. For example, if you are asked whether or not you are married or have children, politely state that you would prefer to remain focused on job-related topics. You could also answer the question but explain your family is very supportive of your work.

    • 5

Give a direct response. There are times when dealing with illegal questions in an interview calls for the direct approach. For instance, if you are asked about your relationship preference or your religion, simply state you will not answer questions about that topic. However, quickly and politely suggest a return to your qualifications or the position requirements.

    • 6

Maintain a positive attitude throughout the interview. Do not allow one or two missteps on the part of the interviewer ruin your interview. You can evaluate whether you really want the job or like the employer after you finish your interview.
