If you have financial setbacks in life, such as your credit cards and other debts falling behind, and creditors are calling, you need this article. It will tell you in simple english how to stop collection harassment dead in it's tracks. I've included a form which you can copy to word or notepad and send to the credit companies that are calling you, and disturbing your life.

The sample letter is very simple to use, written by a law professional who helped me out, and needs very little modification of the letter for your use. There are quotes from the fair credit reporting act, that support your letter, and provides you with undisputable proof should a creditor call you, breaking the law.

Use the law and tools to fight back against credit card companies, bad debt collection services and forclosure.

      Fight Debt collectors

      The first and perhaps, the most important thing is PROPER documentation.

      Start documenting the calls that are made to you by the collection company. Use a notepad, Microsoft Excel spreadsheet or day planner.

      The format that I used (which is court admissible) is as follows:

      Date:
      Time (24hr):
      Calling Party: (name of credit company agent, and agent # if possible)
      Collection Company: (the collector who is handling the collection of the alleged debt).
      For O.C. (original creditor): The original company you allegedly owe the debt to.
      Approximate call time: (if on your cell phone, check your call logs)

      TP-7 mic - put in ear, connect to recorder, talk like normal on your phone

      Record the calls! This is indisputable proof of harassment or violations of the FCRA.

      To record the call you MUST (each and every time):
      Tell the agent that you are on a "monitored" or "recorded" line.

      By law you must identify yourself with your name, identify that the creditor is calling for you, then notify them that the call is recorded. More of this in the next step). If you do not notify them, you MAY NOT use the recording as evidence!

      Here is my script:

      Agent - Is (your name) available?
      You - This is (your name), May I ask who is calling? (they must tell you their name, **ignore all questions until you complete this script**)
      You - What company are you calling from? (they must tell you)
      You - What debt is this regarding? What is the account number?
      *** After receiving this information, you must then serve them the notification of recording!***
      "(agent name), This is (your name) and you are calling me on a monitored line that MAY be recorded."

      That's all you have to do. If they continue the conversation, you have the legal right to use the recording in court, and as evidence of any violation of the law. (For more on telephone recording and Surveillance, please read the Federal Wiretapping Act, along with State Specific laws regarding this subject)

      For recording, I use:

      Olympus VN-3100PC voice recorder from Radio Shack ($49.99)
      TP-7 "Ear to recorder" phone tapper ($19.99 -See Picture)

      You don't need anything fancy.

      You can also opt for a micro-cassette recorder if you want if you want 100% indisputable proof of a recording. Even though digital tape recorders are convenient and smaller, and usually are permitted as proof, they have come under scrutiny by Lawyers and Judges.

      Stop those collection calls now!

      After EACH call, Fill out the following form:

      [Your Name]
      [Your Mailing Address]
      [Your City/State/Zip]

      Certified Mail Tracking# [Insert the Certified Mail Receipt Number here]
      *Return Receipt Requested *

      [Insert today's Date]

      [Insert name of collection agent]
      [Insert name of collection agency]
      [Insert address of collection agency]
      [Insert City/State/Zip of collection agency]

      REF: Account # [Insert either the original account number or the collection agency's account reference number here, but specify which account # you are using]

      Dear [Insert name of debt collector or collection company here]:

      You are hereby notified under provisions of Public Laws 95-109 and 99-361, also known as the Fair Debt Collection Practices Act, that all your telephone communications are no longer desired.

      You and your organization must CEASE & DESIST all attempts to communicate by telephone, at any number you may have for me, my family, friends and work.

      Failure to comply with this, and all applicable law(s) will result in my immediately filing a complaint with the Federal Trade Commission. Violation of this request may result in pursuit in all criminal and civil claims against you and your company.

      Let this letter also serve as a written warning that I may utilize telephone recording devices in order to document any telephone conversations that we may have in the future.

      Make two copies of the above form.

      Send one to the creditor or collection agency via certified mail with return receipt.

      Keep the other in your records along with the voice recordings for evidence.
