How to Write an EEOC Complaint

Employers are required to treat all potential employees fairly and similarly, regardless of the applicant's race, sexual orientation, ethnicity or religion. The Equal Employment Opportunity Commission handles complaints from people who feel they have been victims of workplace discrimination. If you wish to complain to the EEOC because you feel you were discriminated against by a company during your job search, here are some steps to guide you.

Instructions

    • 1

Find your local EEOC field office. Although you might be able to file a complaint online or through the mail, you should speak with an employment professional who will not only guide you through the complaint process but will also tell you whether your complaint is legitimate.

    • 2

Complete the questionnaire provided by the EEOC field office. It will ask you about the nature of the complaint, when the alleged violation occurred and what level of employee was involved. This questionnaire is critical to the processing of your claim, so be honest, be careful and ask questions if you're confused.

    • 3

Provide pertinent details about the employer. This includes the name, address, phone number, website and contact name. Provide a concise but complete description of what happened. Avoid emotional statements and stick to the facts.

    • 4

Keep in mind the rules of the complaint system. You must file your complaint within 180 days of the incident. This may be extended to 300 days if the EEOC office also believes you were discriminated against, but be sure to file within 180 days.

    • 5

Wait for a resolution. While there is no specified time limit, it could take as long as a year to get a decision on your case. The best way to stay informed is to remain in frequent contact with your caseworker.
