Step 1
The first step is prevention. When showing prospective tenants your rentals make your rules clear. Make sure noise issues are addressed in the lease and write out the main rules on a separate piece of paper so prospective tenants can review them easily.

Step 2
Check with the city about any laws pertaining to noise. Most cities have laws against noise late at night. Although a noisy tenant can be disturbing during the day as well, most complaints occur at night. When dealing with a noisy tenant, draw a hard line. Remind them that these issues are against their lease and against the law.

Step 3
Follow up with a written notice. This provides a paper trail and cements the issue for your renter.

on 12/3/2009 I am a tenant....I have a couple above me that is up till 4:30 am every night....the ceiling cracks like thunder when they walk.....the guy below mw talks at the top of his voice on his cell phone till 1:30 am....the 3 tenants beside me yell in a foreign langusge, whooping it up till 1am....my daughter is afraid for me to take the LL to court because her brother is a big atty....the lease says quiet after 10pm.......is it worth a fight with money I don't have or should I go onto the street....I am out of money for another sec dep for another apt...Jan
