How to Register a Business Name in New South Wales

You can use your own name when doing business in New South Wales. If you decide to do business under another name, you have to wait until you've got your business name registered. The "Office of Fair Trading" coordinates the name registration process. Make sure that your name is unique and that another business isn't using it. The New South Wales government website provides the links listed in this article's steps (see Resources below).

      Check your proposed business name with IP Australia's "Trademarks Database," (See Resources below.) Select the hyperlink leading to their online Australian trade marks search system. Enter as a guest; complete the fields below, write the business name you want in the word/image field. Click search and examine the names that come up. Know that even if you get zero results, the trademark examiner will still match your proposed name to the trademark database.

      Check your proposed business name against Australia's national name's index (see Resources below). Write your proposed business name in the field asking for organization name. Select "all names" in the "search on" section under the name field. Click "search" and review the list of names that come up. Find another name if the name you wanted is taken then repeat Step 1.

      Proceed to business name hyperlink on the "New South Wales Government Department of Commerce Office of Fair Trading" website, business section. Scroll down to the "how to apply" section, and click on "business name registration" hyperlink to get to the registration forms. Select "Application for Registration of a Business Name" form hyperlink (see Resources below).

      Complete the fields for your name, address, business name, business nature, your intentions to do trade, Australian Business Number, business street address, and the personal information for everybody involved with your business.

      Submit your application to the nearest Fair Trading Centre address. Proceed to the "Fair Trading Centre" hyperlink on the "New South Wales Government" website in Step 3 (see Resources below). Select the hyperlink to the city or town closest to your address, and record the address and phone number. Know that you can also send your application to their address: "Office of Fair Trading; PO Box 972; Parramatta NSW 2124." Call them at 13 32 20 from 8:30 AM to 5:00 PM Monday to Friday in case you have questions.
