How to File a Class Action Suit

A class-action suit occurs when many people suffer similar damages as a result of the actions of one company. Claimants decide to file a collective suit rather than individual ones. Similar to the class action suit brought against Victoria Secrets, many people band together as one to add credance to the case.

Instructions

1. Determine the extent of damages. In a class-action suit you must have similar damages experienced by all people involved. Additionally, the damages must be substantial enough to warrant going through the court system hiring an attorney to get compensation for the damages. Do a little homework before filing suit.

2. Seek the advice of a class action suit attorney. Before seeking and gathering a whole bunch of people that have the same issue that you have with a particular company, spend a little time talking to an attorney. Make sure the attorney is familiar with the process of filing and trying class action suits.

3. Gather the claimants. If the attorney recommends that a class-action suit is viable, then it's time to gather a list of the claimants who have similar issue with the offending company.

4. Wait for the court's opinion. The court system, not the attorney, determines whether or not the suit is better tried as a class action suit or on an individual basis.

5. Proceed with the class action suit. Assuming that the court system agrees that your grievance is a class action suit, it's time for you and your attorney to sit down do what is necessary to proceed.
