A class-action suit occurs when many people suffer similar damages as a result of the actions of one company. Claimants decide to file a collective suit rather than individual ones.       Determine the extent of damages. In a class-action suit you must have similar damages experienced by all people involved. Before seeking and gathering a whole bunch of people that have the same issue that you have with a particular company, spend a little time talking to an attorney. Make sure the attorney is familiar with the process of filing and trying class action suits.

      Gather the claimants. If the attorney recommends that a class-action suit is viable, then it's time to gather a list of the claimants who have similar issue with the offending company.

      Wait for the court's opinion. The court system, not the attorney, determines whether or not the suit is better tried as a class action suit or on an individual basis.
