If you have ever had a pending DUI charge against you, then you know how difficult it can be to be cleared of the charges against DUI, otherwise known as Driving Under the Influence. Depending on the state in which you live the laws may vary, but most DUI's can be expunged if you follow a few pertinent steps.

Things You'll Need:

  • A good criminal lawyer
  • Proof you weren't drunk
  • A BAC reading of less than .08%.
  1. Step 1

    First it's best to take a field sobriety test if you have ever been stopped by a police officer and asked to pull over. They aren't a mandatory requirement, but, however, a road side breathalyzer is. A police officer will perform this test to determine your level of impairment. Refusing to allow an officer to take this test can lead to trumped up charges, and serious consequences. So, when asked to, always do cooperate with your officer. In all 50 states the BAC level is above .08% any reading at that and above tests positive for DUI.

  2. Step 2

    Keep in mind that breathalyser tests are based on the law of the average person. If your BAC or Blood Alchol Content measurements differ from that of the average person, then your BAC may not have been measured correctly.

  3. Step 3

    Remember, also that some non-intoxicating alixers such as coffee lattes can make breathalyzer tests show a false-positive testing result.

  4. Step 4

    If you have the proof to show that you were not impaired at the time of arrest and testing, then you may be able to avoid the conviction of DUI, and if your BAC levels have not gone above the .08% range. If the statein which you reside in can provide ample evidence that you were still indeed drunk at the time of BAC, it will not matter if the measurement was below .08%, and you could still be convicted of DUI.
