File a Discrimination Lawsuit

Despite regulations and laws to protect employees from being discriminated against there are still many cases of discrimination each year. Discrimination comes in many forms, sexual, race, color, religion, age and national origin. If you feel you have been treated unfairly by your employer it's necessary to follow certain procedures to file a discrimination lawsuit.

Instructions

    • 1

Be ready to give your personal information in a report: your name, address and phone number. Gather the phone numbers and address of your employer to add to your report.

    • 2

File your claim with the Equal Employment Opportunity Commission, EEOC, within 180 days of the discrimination. File within 300 days if you are covered by the equal pay act, or are covered by your local government or state anti-discrimination laws.

    • 3

Submit your discrimination charge by personally going to the EEOC office, making a phone call or mail in the complaint. Call the EEOC at (800)669-4000 or (800) 669-6820 (TDD) to get the location of your local EEOC office.

    • 4

Wait to hear from the EEOC to see what they find about your case. Wait to hire an attorney when you wish for the EEOC to handle the case for you. Hire an attorney earlier in the process if you wish, but only after you have filed a claim with the EEOC.
