How to Identify a State's Requirement for Workers' Comp

Learn about your states workers' comp requirements to help yourself understand if you qualify to file a claim. The requirements are general public knowledge and should not be withheld from you should you ask. You must follow the requirements as outlined by your state in order to qualify for and receive workers' comp benefits.

  1. Step 1

    Identify your state's contact for the workers' comp office or website (Resource 1). If you do not find what you need at Resource 1, search the Internet for "(your state) workers' comp requirements." Each state should have its own workers' comp website.

  2. Step 2

    Consult your state's website for the requirements or call the office to get information about your state requirements. If you are the employee, your employer has to provide you with the state office information.

  3. Step 3

    Request specific information about qualifying for workers' comp or if you are a business owner, need to pay the state workers' comp for your employees. Ask about pre-existing conditions that would disqualify a person. Find out about employers fighting worker' comp claims.

  4. Step 4

    Meet your states workers' comp requirements for paying into the state for your employees. Follow the requirements to file and receive workers' comp. Make a checklist or follow the states checklist to ensure you meet all the requirements and do not get disqualified.

  • If you are a federal employee, the Office of Workers' Compensation Programs (OWCP) helps you with your workers' comp, regardless of the state.
