How to Handle Being Accused of Theft

Being accused of stealing is not something to take lightly. There can be serious consequences, whether you did it or not. Besides the legal aspect, if your employer is the one making the accusation, you run the risk of getting fired, even if you didn't do it. There are ways to handle this situation, however, to give yourself a fighting chance.

      Talk to your union representative if you're part of a union and the accuser is your employer. He can advise you and set you up with an attorney for representation.

      Keep your mouth shut. Even if you didn't do it, lawyers and law enforcement officers can twist something you say. If you're arrested, ask for your lawyer; if you don't have one, ask for a public defender.

      Discuss the situation with an attorney. Be honest with him about where you were when the crime took place. If you did do it, your best option may be to enter a guilty plea (or nolo contendere, depending on your state's laws) and negotiate a reduced sentence (like probation only). If you didn't do it, then cooperate fully with your lawyer providing any potential witnesses or other evidence that proves your innocence. Don't leave anything out of this discussion, even if you don't think something is important, your lawyer may be able to use it in your defense.

      Prepare yourself for any aftermath. If you're guilty, you may have to serve jail time, deal with a probation sentence, pay restitution or a combination of the three. If the theft was from your place of employment, your employer will most likely fire you, so be prepared to explain the situation to future potential employers.
