How to Avoid Hiring Illegal Immigrants

Although you may not get caught hiring illegal aliens, as a respectable business owner, you should avoid doing so. The federal government imposes significant penalties on businesses that hire illegal aliens.

Instructions

    • 1

Ask that each potential employee fill out a complete application. The application should request the person's social security number and full legal name. You'll also want to ask if the person is eligible to work in the United States.

    • 2

Get a copy of the person's driver's license or alien registration card. Make a copy of the form of identification to prove the person's citizenship. You should keep a copy of the proof of ID in the employee's personnel file.

    • 3

Give the potential employee an I-9 form to fill out. The I-9 is provided by the Department of Homeland Security and is used to verify employment eligibility. On the form, the applicant must attest to citizenship or alien authorization. The employer must sign that the candidate provided proof of identity along with the form.

    • 4

Use the E-Verify government software (see Resources). Employers can put in potential job candidates' social security numbers as a way to verify citizenship. You can find the software through the Social Security Administration's website.

Tips & Warnings

  • You must put each potential employee through the same verification process. Otherwise, you're violating anti-discrimination laws.

  • If you're not personally performing the hiring for your business, make sure you train your human resources department on how to properly verify citizenship.
