When you're involved in a car accident and the other person is at fault, request a promissory note from the at-fault party to document his intention to pay you for the damages. If he doesn't follow through you can use the note in court.

Step1
File a claim in small claims court or in general civil court, depending on the amount of your claim. If you are filing in general civil court, hire an attorney because the documents needed to file are extensive.
Step2
Bring the automobile accident promissory note to court.
Step3
Present the promissory note to the judge and keep a copy for yourself. The court will rule on the validity of the signature and the note. If the court finds in your favor, the note may be enough to win your case.
