How to Deal With Being Falsely Accused of a Crime
You are undergoing questioning by police about a crime you didn't commit. Officers are making accusatory statements and demanding answers. You feel frightened and confused. Keep your wits about you and don't panic. This is the best way to deal with being falsely accused of a crime.

Stay calm and restrained. Even if officers say hurtful things that make you angry, it's extremely important to keep your composure. Becoming aggressive will not help the situation and can only hurt your case.

Ask if you are under arrest. If the answer is "No," you have the right to refuse questioning and leave. If the answer is "Yes," you can refuse to answer any questions or make any statements (written or oral) until your attorney is present.

Request a public defender, if you don't have an attorney. As the accused, you have a right to free counsel if you can't afford legal help. Once you request an attorney, officers are obligated under law to suspend questioning until your attorney is in the room and has had time to confer privately with you.

Provide your attorney with full disclosure about your activities. Even though you are innocent of the crime at hand, any lie uncovered by the prosecution can sabotage your case. Leave nothing to chance. Tell your attorney everything, no matter how embarrassing certain details may be. Your attorney must adhere to strict confidentiality laws and can't discuss such details with anyone but you. The defense attorney works for you, and will keep embarrassing details out of the courtroom unless absolutely necessary to your defense.

Write down as many details as you can about the case, and any questions you have for your attorney after you bond out. A written record can help keep your memory fresh. Wait until bonding is complete and you've left the police station before writing these things down. If you remain in police custody, don't write anything down.

Think carefully about any people or written records such as gas or restaurant receipts that can provide an alibi for your whereabouts when the crime was committed.

My husband has been falsely accused of possessing a firearm without consent. The owners of the shotgun asked my husband to pawn the gun so that they were able to pay their gas bill that was going to disconnected and two months behind. The couple were reported for child abuse. Because of the abuse being filed they are now claiming that my husband stole their gun. The girlfriend is the one that handed my husband the shotgun and told him which pawn shop to take it to. The boyfriend has several other items pawned at the same location. Right now it is "he said, she said". My husband and I both gave our statements which were almost exactly alike and gave them more information than what they were expecting. I have been told by both the boyfriend and the girlfriend where the shotgun was and that they asked my husband to pawn it. How do I save my husband from the bogus charges that... -

I am in the military and know several polygraph examiners. A big problem with polygraph exams is that sometimes they are not done correctly, and instead of determining if someone is telling the truth, they are more concerned about getting the person to talk or confess. These kind of polygraphs, especially if not administered correctly are usually not admitted in court. It is very important to understand why some are admitted and others are not. I have a question! You see someone I love and care about very much was set up and then accused of child porn when it was not even done and yet the police and the parol officer does not want to believe it. They haven't even checked anything they just went and just started to accuss without any evidence or anything. Now it is killing me and his family of what they are doing to him. How do I get it to where he has a normal or almost normal life with me and his family again? I am wondering if also there is a way to clear him from that and just have it done. They give him,his family and now me a hard time and say that everything we try to tell them is a lie and did not happen. I just don't know what to do anymore but I would love to hear some advise and hopefully it helps! i was accused with 4 felonies burglary and 3 charges for having and illegal firearm in the trunk of the car, the car was parked but i was in the drivers seat it wasnt my car its owned by my uncle but drove by my 17 year old cousin whose facing the same for charges my bond was set at 20,000 but was released on a ibond of 10% but i have court on the 28th of April, i had no knowledge of the firearms being in the trunk of the vehicle my cousin was seen running back in the car from a driveway, where a car was parked open which my cousin took something out of that's what the cops said, but wasn't proven so we both are facing the for felonies and i cant afford a lawyer someone please help me because im only 18 i spent 2 days in will county jail in Illinois and i do not want to go back there so if theres a lawyer out there that could help me and give me a payment plan im more then willing to... -

My Grandma has worked at this bank for like 30 years maybe longer Im not sure. But today she was fired by her jerk of a boss because her counter where she has to keep the money is supposedly $2039 short. She was not given a chance to prove she didnt do it and was immediatly removed. She is 65 and I know she is innocent but i just dont know how to prove it. What should I do?
