How to Handle a DUI With a Guilty Plea

A driving under the influence charge carries with it stiff penalties, especially if you have a past record of DUIs. Pleading guilty to a DUI can be a wise choice, if you can get the judge to understand that you are truly wanting to work on never getting another DUI.

  1. Step 1

    Show up to court on the day you are expected to be there. When your name is called for your arraignment, tell the prosecutor or judge that you wish to plead guilty to your DUI.

  2. Step 2

    Meet with the prosecutor before your scheduled court date to plead guilty to your DUI, if you so choose. Meeting in advance of the plea often allows you to privately discuss your options with the prosecutor or assistant prosecutor. In this meeting you may be able to negotiate down your charge in exchange for the guilty plea.

  3. Step 3

    Listen to what the judge or prosecutor has to say about your particular case. The judge or prosecutor will give you important information about what will be expected of you next. You likely will be sentenced to a choice of jail time or a DUI class, if you have never been convicted of a DUI charge before and if your DUI is a lower-level misdemeanor. You are expected to tell the judge right then and there which one you will choose. If you choose jail, you may be expected to go off to jail right then.

  4. Step 4

    Attend the DUI class, if that was the option the judge provided you. This is usually a multi-session class on weekends or evenings that allows you to learn driving techniques and information about drinking and driving.

  5. Step 5

    Pay the fine. Your guilty plea to a DUI likely involves a sentence of a fine of several hundred dollars at the minimum. Pay this fine quickly, or late fees can add up.
