      When you receive a collection call, get the persons full name, mark the time that they called and where they are from.

      Get their fax number, and an address to mail a certified letter to. Tell them you are going to send a cease and desist letter. They will probably keep talking. tell them you need the information or a phone number to call back to get the info you need. Dont Back down. Be persistant but not rude

      Put together a letter, that includes, your name,address, account number, . Write the letter something like this.
      I am writing you to tell you to cease and desist all further calls. Do not call my home number, work number or any other number you may have. Continuing to call will be breaking the fair debt collection act. All further correspondence is to be by mail only.

      If you just dont want to answer your phone, you dont have to. Put the letter together, i would suggest sending it certified or faxing if you have the number and your fax machine shows proof it went through. If the collection agency continue to call after the letter has been received you can act on the fair debt collection act. Consult an attorney.

Tips & Warnings

  • This letter will get the calls to stop, however remember that some creditors will send your file to an attorney. Most do not. I will be compiling a list of the ones that generally do not. Also one more thing. To the bill collectors you do speak with, keep in mind for the Real Collections agency's (not the ones that are hired to pretend they are, there are attorneys that will send letters in hopes to scare the person) be as nice as possible. Yes some maybe be extremely rude, but make the wrong one mad and they just might forward your file to an attorney.
