Many people are compelled to call a lawyer when conflict arises; however, litigation is expensive and time consuming. If you're concerned about the cost of conflict in your organization, consider instituting an Alternative Dispute Resolution (ADR) program. Mediation through ADR can save your company money and unnecessary stress.

Instructions

    • 1

Create a company hierarchy for conflict resolution, beginning with positive communication between disputing parties and then progressing through mediation and ending with arbitration if necessary.

    • 2

Educate existing staff members about your company's alternate dispute resolution process. Provide all staff with training in basic communication skills. Encourage staff to solve conflict independently by using positive communication skills.

    • 3

Institute a procedure, whereby employees who have failed to resolve disputes independently can request mediation services.

    • 4

Train staff members from various departments to serve as mediators within your company. Contact the Association for Conflict Resolution at (202) 464-9700. Obtain information regarding local mediator training courses.

    • 5

Meet with your company's lawyer and your human resources department to discuss the inclusion of an ADR clause into new employee contracts. Finalize contracts with the ADR clause.

    • 6

Review the ADR clause during new employee orientation. Explain the hierarchy of conflict resolution in your company. Require new employees to sign a form stating that they understand the company's ADR process.

    • 7

Incorporate ADR clauses into agreements your company enters with other companies. Include statements that require disputing parties to engage in mediation for a set number of days prior to pursuing arbitration or litigation.

Tips & Warnings

  • Be proactive and start your ADR program before conflict arises.
