How to Create Freelance Agreements

Corporate freelance clients offer up their own written assignment agreements. But there's a lot of work out there from people and companies that are less sophisticated and have fewer resources. Since you'll want a contract of some sort to protect yourself, it's a good idea to create your own. And, it's easier than you think.

  • Time for research
  • Ability to write plain language

Step1
Take the easy path by modifying agreements you have from clients or ask other freelancers for a copy of their template. These have been checked out or written by lawyers, so you can be up and running quickly.
Step2
Whether using a template or writing it from scratch, keep the agreement simple and focused on the work to be performed. Tossing in a bunch of irrelevant language or packing it with legal jargon can make your prospective client uneasy and delay the signing.
Step3
Be specific about deadlines for delivery, the scope of the work, the payment and the terms of payment. Some freelancers simply list these as bullet points at the appropriate place in the document.
Step4
Use plain language, not legalese. Clear writing fosters greater understanding and leaves an impression of honesty and candor.

Tips & Warnings

  • The primary goal of a written agreement is to ensure both parties understand what is to be done, when and for how much. Putting it in writing greatly reduces or eliminates the potential for misunderstanding.
  • If the assignment changes, insist on a new agreement or at least something in writing to which you and your client can refer. Emails work, particularly when you have an ongoing relationship.
  • It doesn't hurt to have a lawyer review your basic template.
