Have you ever considered suing the store or business but thought that traveling across the country to a court trial was too much? Well, there are ways available to you so that you can sue a business or store even if they are in a distant city.

How to sue a business in another city

Step1
The court that will try your matter is the one located in the jurisdiction of the defendant. This means that normally, you would have to travel to where you purchased the item and sue them at that location.
Step2
But if the store is an affiliate, meaning it’s one of many branches of the same store, then the court that would hear your matter would be in the jurisdiction to you that has the same affiliate store. So, if your city has the same named store, then you could sue right from where you live, or if it’s the adjoining city or town, then you would only have to travel to that point to the courthouse there.
Step3
Since every branch of store normally follows similar protocol, the manager from the store nearest you would come to court as the representative for the business as a whole. Or the business might choose a district manager to speak for them.
Step4
If the store personnel of the branch that you purchased your item(s) from is directly involved with your issues, then that person could be summoned to come out to the trial to testify.

Tips & Warnings

  • The business you are suing could bring a motion asking that the trial be held in their jurisdiction so that their witness, the employee who is directly involved with your issues, doesn’t have to travel. The judge makes the ultimate decision.
  • Before you begin filing a claim against the business, you should get legal advice and even consider hiring a lawyer to represent you.
