Step 1
Determine the key points that both parties conflict over. Make two detailed lists. One should include why you should have custody and the other list should be why your ex should not have custody. Keep it as concise and to the point as possible and try not to make it too long.

Check off any dead ends. If you have already found sufficient proof for certain issues or if proof cannot be found then cross it off your list. Be creative when determining if an issue cannot be proven. For example, something that may seem to be one word against another may be swayed by a third party witness who has no loyalty to either side.

Gather more physical evidence. If necessary, hire a private investigator to take pictures of your ex engaging in inappropriate behaviors such as keeping the kids out late on a school night or drinking and driving with them in the car. Be sure to also obtain physical proof of the reasons why you should be the sole parent with custody. For example, if in the past you had trouble holding down a job and it is being used against you, get a letter of recommendation from your current employer outlining the stability of your current job.
