Step1
You should seek legal advice as to your options and legal possibilities in filing a claim of this type. You can get the phone number from the courthouse or a legal service that offers several minutes of free counsel.
Step2
It could be difficult to prove that the artist did the wrong picture unless you have a specific picture that you can swear that you instructed the artist to follow.
Step3
Even if you have a picture, you will need to prove in writing or through a witness that the artist guaranteed a replica of that specific picture.
Step4
If you got an infection, the artist will likely argue that you didn’t properly care for the skin while it was healing, and that it is your agreed responsibility and not theirs.
Step5
You will likely have to prove that you were perfectly healthy before you got the tattoo as they might suggest that you were already ill.

  • It is very difficult to prove negligence for this type of matter. However, it could be just as difficult for the artist to prove otherwise.
