Several states in the union, including California and Arizona have been recently adding photo radar cameras to busy intersections, freeways and other high density traffic areas. These devices will clock your speed and if you are going so many miles over the posted speed limit they will snap a photo of the driver and the plate. Many people get flustered when they receive a photo-radar speeding ticket citation in the mail a few weeks later that costs them hundreds of dollars. But this flagrant violation of privacy, entrapment and civil rights is actually very easy to beat in court. Here is how you get out of a photo radar ticket without having to spend a dime.

Step1
Research the area you were ticketed in. The law requires that they post signage within 300 feet of the photo radar device. Most often cities fail to comply with this law. Check out the area you were ticketed in, more than likely there is no sign there--case dismissed.
Step2
Research the company that makes the photo radar units. These companies all have a website and they are required by law to post the proper maintenance requirements and the margin of error that these devices produce. Save this information for court.
Step3
Create your exhibitions of evidence. You want to have two things, the maintenance records of the camera that ticketed you, and the testing results from the company that manufactured the camera, which will show a slight margin of error.
Step4
Present your case and win. Calmly present your case and enter both researched items as exhibitions of evidence. Explain to the judge that for one, while the photo resembles your person driving the car, it could very well be somebody else. There is no DNA evidence that confirms this picture is actually you. Second, present how often the camera in that region is maintained, and more then likely it is past due. Ask how it can function accurately in that case. Finally, demonstrate to the court that these cameras all have a margin of error, as small as it may be, there is still credible and reasonable doubt that you fall into that margin of error. Where there is even a slight shadow of reasonable doubt, the court must rule in your favor.

Tips & Warnings

  • Remember you are innocent until proven guilty and this means they have to prove you were speeding beyond a reasonable doubt, which is very difficult to do.
  • Make sure to have well presented arguments and to not lose your temper while in court.
