How to remove the logo patch from (photo shop) picture

I download a picture. but that picture has one logo patch from top layer. I only need to remove that logo patch from picture. with out damage my correct picture.How to remove the logo patch from (photo shop). one of my friend tell me to can remove 1st logo patch layer without damage 2nd layer
