Difficulty: Moderately Easy
Step1
Consult with a lawyer if your workmen's compensation case is complex, if your company refuses to acknowledge that you have a claim or if you have been fired or threatened as a result of your injury. This is especially important if your injuries are severe, as you may be entitled to a large settlement that only a lawyer can arrange.
Step2
Take quick action if you are injured. Seek medical attention first to determine the extent of your injuries.
Step3
Consult the workers' compensation program contacts list on the US Department of Labor website (see Resources below). Here you can learn where agencies are located in your state. Most listings on this page include contact telephone numbers and addresses, as well as the name of the each agency's director, chairman or administrator.
Step4
File a Notice of Injury (using a form you can obtain from your employer) with the United States Department of Labor. Complete the Notice of Injury form with as many details as possible. The form will ask for your personal information and the specific details of your injury, including where and when the accident took place, what you were doing at the time and what treatment you received.
Step5
Make sure you save all your receipts, medical reports, proof of lost wages and any other items that may help you obtain additional workmen's compensation later. This is especially important if there were no witnesses to the event and you need to prove your case.
