How to Testify in Court

Witnesses who testify in court are called to tell the truth and to uphold the rules and laws of the court. To testify in court, a person needs to know how to answer questions properly and how to prepare for the atmosphere of the courtroom. Instructions

1. Dress appropriately for court. Dress in a professional manner to exude confidence. Business attire is standard courtroom dress. Avoid appearing too casual or overdressed as this is a distraction to the jury.

2. Tell the truth at all times. Realize that before you testify, you swear an oath to tell the truth. Make statements clearly and concisely without adding confusing words. Be straightforward.

3. Answer questions with a "yes" or "no" when required and give no further statement unless warranted. Only the specific question asked should be answered. Avoid offering more detail than what is required.

4. Express that you don't remember a detail if you forget something. It's not against the law to forget details. Simply state that you don't remember.

5. Respond to every question in a verbal manner while you testify in court. Don't nod your head for "yes" or shake your head for "no" answers. The court reporter needs to have an oral response to record.

6. State details that you personally witnessed when you testify in court. Don't speculate based upon other testimony.

• Perjury is against the law and is severely punished. The penalty for lying under oath could be in the form of jail time or a fine. Lying also damages the integrity of the case.
