Paternity fraud is where a man is deceived into believing that he is the parent of a child for the monetary gains of the mother. Paternity fraud cases that are successful have the ability to recover the lost monetary amounts from the real biological father and other amounts from the mother for fraud.

  1. Step 1

    Prove through credible medical testing that you are not the father. This is performed through DNA testing. The test is very simple. All that is needed is a swab of the mouth cavity and saliva from both the child and the potential father. The test will determine beyond a shadow of doubt whether the child and father are related by blood.

  2. Step 2

    Find out who the real father is. You can then sue him for back support, medical insurance and other necessities. You will also be stating that he is the real biological father of the child.

  3. Step 3

    Determine if the woman knew that you were not the father and told anyone during or after the pregnancy. She can then be sued for fraud. Damages can be awarded to the man for the mental suffering of thinking he had a child and then finding out that he was not the father.
